Low Risk Driving and Trailer Towing courses terms and conditions

  1. Product Offer

    In these terms and conditions National Driver Education Pty Ltd ACN 106 026 966 is referred to as "we", "our" and "us”.

    1. You will be participating in the Low Risk Driving Diving Course or The Introduction to Trailer Towing provided by National Driver Education Pty Ltd. The Training consists of two components, an in training room session at the client’s workplace or agreed location and practical driving session on public roads nearby to the classroom location.
    2. To enrol in a Training session you and all participants you are enrolling ( if being enrolled by an organisation’s nominated person ) must hold a current Australian Drivers Licence suited to the vehicle you will drive in all courses offered.
    3. National Driver Education Pty Ltd has the right to cancel or postpone a Training session if a minimum number of participants have not registered. National Driver Education will provide 48 hours’ notice of any cancellation or postponement of a Training session, and you will be able to elect to reschedule or to receive for a refund if we are unable to provide a suitable replacement date and location.
    4. Each participant must bring your current driving licence to the Training session. If you do not do so, you may complete the Theory element but you will not be eligible to complete the Practical element of the Training on that day. Depending on the availability of spaces in further training sessions you may be able complete the Practical on an alternative day.
    5. When registering and undertaking a Training course you are supplying personal details of yourself or attendees you are organising a course for. Your information and the information of all course participants will be treated in accordance with the National Driver Education Pty Limited Privacy Policy. This can be found at the bottom of this document.
  2. Payment conditions:
    1. Payment for all courses must be made within 14 days of course completion of all attendees.
    2. Payments can be made by electronic Funds Transfer or by credit/debit cards (Visa, Mastercard via secure payment gateway ).
    3. Group bookings for all National Driver Education Pty Ltd training must be made by client supervisor, WHS Manager, Fleet Manager of the clients nominated responsible person for booking training. The client warrants to us that all persons booked into a course are 18 or more years of age, and that all information given by you to us through any booking channel (including your name, contact and address details) is correct.
    4. Group bookings for all National Driver Education Pty Ltd training must be made by client supervisor, WHS Manager, Fleet Manager of the clients nominated responsible person for booking training.   3. Cancellation Policy:
    1. If you ( the client ) wishes to cancel a booked training session with more than seven days’ notice, there will be no fee charged.
    2. If you ( the client ) cancel a booked course within 7 days of a booked training session at you may be liable for 50% of the course fee.
    3. If you ( the client ) books an employee into a course and that person fails to attend you may be liable for the full course fee.
    4. If you need to reschedule within the 7 days prior to your scheduled training session National Driver Education Pty Ltd will make all reasonable attempts to reschedule to a suitable alternative session time and date.
    5. If we are unable to reschedule the session and/or you wish to cancel, then you will not be charged a course fee.
  4. Our right to terminate

    We reserve the right at our reasonable discretion to refuse to provide training where we deem an individual undertaking the training session as unfit to partake in the training (including but not limited to the ability to operate a vehicle).

    We reserve the right to terminate participation in any National Driver Education Pty Ltd training sessions if:

    1. You engage in any behaviour that our trainer determines is reckless; or
    2. You fail to comply with the instructions or directions of the trainer or assessor before or during the Training session; or
    3. You fail to comply with any special conditions on your licence (including but not limited to the wearing of glasses / contact lens); or
    4. The trainer has assessed your driving skills and competence and deems them to be unfit or unsafe to drive.

    If your participation training is terminated under the circumstances listed above you may forfeit the full fee of the participant at the discretion of National Driver Education Pty Ltd.

  5. PROVISION OF LOW RISK DRIVING COUIRSES AND TRAILER TOWING COURSES

    When undertaking the Training:

    1. Your course participants will at all times follow all reasonable instructions of our trainer;
    2. We will provide you with materials such as The Low Risk Driving Workbooks and Course notes.. The information provided is general information and we do not guarantee the accuracy of the information as it may vary over time.
    3. Upon completion of the course you will receive an electronic certificate via email of attendance. This certificate is a certificate of attendance and is not to be construed as a representation of any particular level of driving skill or qualifications.
    4. You will be responsible for the safety of your personal property on the day. Any loss, damage, liability, costs and expenses in connection with your personal property this will be your responsibility, and neither we nor our driving assessors accept any liability whatsoever for personal property that is left in any assessor supplied vehicle, your vehicle or on our premises.
  6. COMMENCEMENT OF TRAINING
    1. You must be ready to commence the Training session at least 15 minutes prior to the start time, as the Training session will not be delayed. If you turn up more than 30 minutes after the scheduled start time, then the trainer may in their reasonable discretion refuse you entry to the classroom, and in such circumstances you may forfeit the full fee.
    2. Whilst we aim to and will endeavour to commence the Training session at the scheduled time and with the scheduled trainer, no responsibility is taken for any circumstances beyond our control which may delay the start time or result in a change of trainer. If there are circumstances beyond our control which have delayed the start time of your Training session and you cannot attend as a result, then we may offer you training at another time or you may elect for a refund.
  7. INTELLECTUAL PROPERTY

    You agree that we ( National Driver Education Pty Ltd ) own the intellectual property rights in all material provided to you in the Training session. You agree that the intellectual property rights in any material created by you or us during the Training session including modifications or improvements made to the material provided to you by us will vest in us.

  8. VEHICLES

    Generally the Practical on road sessions will be provided using the client’s company vehicles which are to be supplied by the organisation ( the client ) on the day of training.

    If you drive your own vehicle or company vehicle during the Practical, then the trainer in company with the driver will conduct a basic external inspection to satisfy themselves that the vehicle is roadworthy.

    The below requirements must be met in relation to the vehicle ( and Trailers ):

    1. The registration of the vehicle must be valid, and current.
    2. You must hold current compulsory third party insurance and comprehensive insurance cover for the vehicle;
    3. You must have notified your insurance company in writing prior to undertaking the Training that the vehicle being used will be used to provide driving training.
    4. The tyres are correctly inflated (air pressures must reflect the manufacturer's recommendation as a minimum), have appropriate levels of tread and are not damaged;
    5. All indicators and brake lights are working;
    6. Seats and seat belts are in good working order and are not damaged or twisted;
    7. Any loose items in the cabin of the vehicle are stored in the cargo (boot) area;
    8. The windows and interior are clean;
    9. The windscreen is not cracked and shows no signs of damage; and
    10. The vehicle has sufficient fuel to last the course of the training.
  9. FITNESS TO DRIVE
    1. To undertake the Practical you must hold a current Australian Drivers licence in the state that you reside in, and is suited to the class of vehicle you will be driving in the On Road Training session, or equivalent overseas licence. You must carry it with you at all times during the Practical.
    2. In the interests of safety, the trainer may make an assessment of your driving skills and competence at any time during the Practical part of the Workshop. If at any time you are assessed as being unfit or unsafe to drive during the Practical, the trainer may terminate the training immediately and assume control of the vehicle.
    3. When attending a training session you must dress in a manner appropriate to the situation. This includes (but is not limited to) the requirement that you wear appropriate footwear. A flat, enclosed and secure shoe is recommended.
    4. You must turn off your mobile phone prior to starting the Practical in the vehicle.
  10. LIMITATION OF LIABILITY

    Certain State and Commonwealth legislation, including the Competition and Consumer Act 2010 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These terms and conditions do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions.

    You will indemnify us if we suffer any loss or damage or incur any costs in connection with your breach of these terms or any other legal obligation by you in relation to your participation in the Workshop.

    You indemnify and agree to keep us and our related bodies corporate and our and their officers, employees, contractors, franchisees and agents indemnified against any loss, damage, liability, costs and expenses in connection with your breach of these terms and conditions or any other legal obligation by you in relation to your participation in the Workshop.

    When Training takes place in your own vehicle, or a company vehicle you warrant and the company warrants that you are covered by compulsory third party insurance and that your vehicle is covered by comprehensive insurance and has current registration
